§ 4.01 Introduction

The previously discussed systems for dividing property at divorce¹ apply only if there is no enforceable marital agreement. Even when a marital agreement exists, the courts are the final arbiters for interpreting documents that purport to set forth the spouses' respective property rights if a divorce occurs.
