§ 18.04 Summary

The custom of dealings between the parties to the commercial lease, as well as their various actions, inactions or courses of conduct may have a significant impact upon the leasehold relationship or interest. Under common law in many jurisdictions, the lease will be deemed to have been amended by actions of the parties or by waivers of obligations. To guard against this, the lease should provide that such events shall not constitute an amendment.
