X. PREPARATION FOR EVIDENCE DEPOSITION/TRIAL TESTIMONY

After the discovery deposition, the decision must be made as to whether to present the treating physician as a live witness at trial or to present her evidence deposition. A witness who presents well and has important medical opinions and information should be presented live or by videotape evidence deposition. The alternative is to merely read the transcript of the witnesses testimony, a process that is less than intriguing to the jurors. The videotape evidence deposition is expensive as the plaintiff must pay for the doctor's time, the court reporter and the videographer.
