Commission Highlights

During its regularly scheduled meeting of December 13, 1991, the Board of Bar Commissioners received the following reports and took the actions indicated.

1. The Board joined the Weber County Bar for lunch and, in an informal question and answer session following the luncheon, addressed mutual concerns including judicial reorganization, the use of District Courts in the discipline process and the unauthorized practice of law by private insurance adjusters.

2. The minutes of the Commission meeting of November 21, 1991 were approved.

3. Jim Davis reported that he had formed the committee to study the proposed court reorganization bill pursuant to the Board's request consisting of Bill Bohling and Paul Veasy of the Courts and Judges Committee; Commissioners, Craig Snyder and Gayle McKeachnie; and Legislative Affairs Committee Chair, David Bird.

Bill Bohling, Courts and Judges Committee Chair, appeared and outlined the committee's review of the Judicial Reorganization bill.

Craig Snyder distributed a copy of his article on the reorganization bill which was scheduled to appear in the January issue of the Bar Journal.

Dennis Haslam presented a report on issues reviewed in the bill by the Judicial Counsel.

After significant discussion, the Board voted to communicate with the Utah Judicial Council and the Administrative Office of the Courts that based on the review by Bill Bohling and the Commission's ad hoc committee to study judicial reorganization, Dennis Haslam, the Commission's representative to the Judicial Council, and Craig Snyder of the Special Drafting committee, that the following issues should be addressed in order to assure Bar Commission support:

(1) The Bar should be assured of participation in each local area in the process by which magistrates are selected, in a manner substantially equivalent to that already utilized by Judicial Nominating Commissions;

(2) The compensation for magistrates be in sufficient amounts to attract and retain qualified people and encourage their tenure;

(3) That there be substantial representation from the Bar and the public on the drafting committee which would be responsible for the creation and implementation of appropriate rules.

4. John Baldwin distributed November's financial reports and highlights.

5. The Board voted to approve a petition for reinstatement subject to the petitioner passing Character & Fitness and successfully completing the Multistate Professional Responsibility Examination. The Board approved waiving the late filing fees for the bar examination, should the petitioner wish to take the examination in Utah. Bar Counsel agreed to prepare a written summary.

Scott M. Matheson Award

Last year, the Law-Related Education and Law Day Committee of the Utah State Bar was proud to present the first annual Scott M. Matheson Award to Greg Skordas and the law firm of Van Cott, Bagley, Cornwall & McCarthy. Currently, the committee is accepting applications and nominations for the second annual Scott M. Matheson Award to be presented on Law Day, May 1, 1992.

PURPOSE: To recognize those lawyers and law firms who have made an outstanding contribution to law-related education in the State of Utah.

CRITERIA: Nominations and applications will be accepted on behalf of individuals or law firms who have:

1. Made significant contributions to law-related education in the State of Utah which are recognized at local and/or state levels.

2. Voluntarily given their time and resources in support of law-related education, such as serving on planning committees, reviewing or participating in the development of materials and programs and participating in law-related education programs such as the Mentor/Mid-Mentor Program, Mock Trial Program, Volunteer Outreach, Judge for a Day, or other court or classroom...
