Lawyer Discipline

Wyoming LawyerIssue: August, 2011Lawyer DisciplineSuspensions

Riverton attorney Robert O. Anderson has been suspended from the practice of law for one year by order of the Wyoming Supreme Court on June 1, 2011.

The Wyoming Supreme Court had earlier issued an order of interim suspension for Anderson effective March 7, 2011, pending resolution of formal disciplinary charges against him. Following the order of interim suspension a formal charge was filed alleging that Anderson had violated provisions of the Wyoming Rules of Professional Conduct relating to his duties of competence, diligence, communications with clients, and charging of legal fees to clients for whom Anderson did not fulfill his obligations.

On May 19, 2011, the Board of Professional Responsibility issued a report and recommendation to the Wyoming Supreme Court which set forth Anderson's history of alcohol-related problems dating back to 2006. Anderson participated for a number of years in a diversion program aimed at rehabilitation, but was twice convicted of driving under the influence of alcohol during 2010. Concerns were also brought by persons associated with the Fremont County court system and by clients that Anderson was not adequately representing his clients in court proceedings.

Anderson, who had retired from the practice of law and did not wish to contest the formal charge, stipulated to these facts and consented to a one-year suspension. The Board of Professional Responsibility approved the stipulation, recommending that the Wyoming Supreme Court suspend Anderson from the practice of law for one year. After reviewing the report and recommendation, the Wyoming Supreme Court entered its order suspending Anderson for one year, and ordered him to pay costs of $550.00.
