VII. Conclusion

Appellate advocates, like all lawyers, must appreciate their ethical obligations. Zealous advocacy does not excuse lawyers' ignorance of their professional responsibilities in appellate courts any more than it does in trial courts. Lawyers briefing and arguing appeals must be candid with courts. They must avoid false and misleading statements of fact and law, and must not mislead through silence when they ought to speak.
