VI. [§ 12.10] VIOLATION OF THE MARYLAND CREDIT SERVICES BUSINESSES ACT

Acme Credit Rescue, LLC (Acme) advertises that it can repair a consumer's credit history by having negative information deleted from the consumer's credit report. In 2021, John Smith saw Acme's advertisements on its Internet website. Mr. Smith contracted for Acme's services, and paid $500 to Acme up front. Over a year later, Acme has failed to remove any negative information from Smith's credit reports.

COMPLAINT

Violation of the Maryland Credit Services Business Act

John Smith (hereinafter "Smith"), Plaintiff, by his attorneys, Laura P. Taylor and Taylor & Taylor, P.A., sues Acme Credit Rescue, LLC (hereinafter "Acme"), Defendant, and states:
1. Plaintiff Smith is a resident of Baltimore City, Maryland.
2. Defendant Acme is a Maryland limited liability company with its principal place of business in Baltimore City, Maryland.
3. On or about March 15, 2021, Mr. Smith contacted Acme by telephone regarding its "Credit Rescue Kit," which Acme advertises on an Internet website, www.acmecreditrescue.com, and by other means.
4. Through verbal statements made by their representatives, and written statements on its website and elsewhere, Acme offered Mr. Smith services purporting to remove or attempt to remove derogatory information from Mr. Smith's credit reports; Acme further represented that it was able to remove negative information from Smith's credit reports.
5. To induce Mr. Smith to purchase Acme's services, Acme's representatives made statements to Smith such as: "our attorneys remove collections, bankruptcies, charge-offs, late payments, judgments—all negative items" and "we can delete between 75 -95% of the derogatory history."
