Veloz v. New York, 339 F.Supp.2d 505 (S.D.N.Y. 2004). A prisoner brought a pro se [section] 1983 action alleging denial of his right to be free of cruel and unusual punishment, equal protection violations, and violations of the Americans with Disabilities Act (ADA). The district court granted summary judgment in favor of the defendants. The court held that the alleged failure to give the prisoner his prescription medication for back pain relief, even if proven, did not violate the Eighth Amendment.
