Lolli v. County of Orange, 351 F.3d 410 (9th Cir. 2003). A pretrial detainee filed a [section] 1983 action alleging the use of excessive force, and deliberate indifference to his serious medical needs. The district court entered judgment in favor of the defendants. The appeals court affirmed in part, and reversed in part and remanded. The appeals court held that there were genuine issues of material fact, precluding summary judgment, as to whether sheriff's department officers were aware that the detainee was diabetic and was showing signs of a ketoacidic condition, but failed to provide him with food. The court also held that summary judgment was precluded on the issue of whether sheriff's department officers employed excessive force against the detainee.
