Walters v. County of Charleston, 63 Fed.Appx. 116 (4th Cir. 2003) [unpublished]. The personal representative of a detainee who died in custody brought a [section] 1983 action, alleging that the detainee's death was the result of officers' use of excessive force. The district court entered summary judgment in favor of the defendants and the plaintiff appealed. The appeals court affirmed, finding that the officers' use of force in restraining the detainee was not excessive, even though the detainee died as the result of a compression injury to his neck sustained while officers attempted to subdue him.
