Oyedeji v. Ashcroft, 332 F.Supp.2d 747 (M.D.Pa. 2004). An alien who had been imprisoned for more than four years while challenging a removal order petitioned for habeas relief. The district court granted the petition. The court held that the alien's prior convictions, more than seven years earlier, of alleged shoplifting offenses and his prior failure to appear in connection with criminal proceedings did not establish either a risk of flight or a danger to the community that would support the alien's continued detention.
