V. [§ 6.19] FORECLOSURE PROCEEDINGS

John Smith is a trustee under a deed of trust for the benefit of the Baltimore Bank. George Harris Limited Partnership is a partnership engaged in the development of real estate. On January 2, 2020, the George Harris Limited Partnership purchased a property in Baltimore known as 100 Maple Street. To finance this purchase, the George Harris Limited Partnership took out a loan from the Baltimore Bank. The loan terms required the George Harris Limited Partnership to sign a promissory note that was secured by a deed of trust. For approximately two years, the George Harris Limited Partnership made payments to the Baltimore Bank under the terms of the promissory note. In the middle of 2021, the George Harris Limited Partnership fell behind in its payments to the Baltimore Bank and eventually ceased to make payments. As a result, John Smith, the substitute trustee under the deed of trust for the benefit of the Baltimore Bank, brings this action to foreclose on the deed of trust. Deeds of trust, and rights flowing from them, are described in Chicago Title Insurance Co. v. Mary B., 190 Md. App. 305, 988 A.2d 1044 (2010).
