V. [§ 12.9] VIOLATION OF THE MARYLAND CONSUMER PRODUCTS GUARANTY ACT

John Smith purchased a boat manufactured by Harris Boat Corp. from an independent marine dealer in Maryland. Harris provided a written warranty for the boat, which guaranteed repair for any defective features or defective workmanship. After buying the boat, Smith noticed a series of problems, including a cracked keel, electrical defects, and peeling paint. All of the defects were the result of defective workmanship and not the fault of Smith. Smith requested that Harris repair the defects, pursuant to the warranty. Harris unsuccessfully attempted to repair the problems with the boat, but never admitted that the problems were design defaults or the result of defective workmanship. Smith is dissatisfied with Harris' attempts to fix the problems with the boat, as none of the issues Smith complained about have been completely resolved. Smith requests that the promises made in the guarantee be fulfilled. Smith wants Harris to repair the defects with the boat, and pay the reasonable incidental expenses that occurred as a result of Harris' breach of the warranty. Finally, Smith requests that Harris pay Smith's attorney's fees and costs.
