Graham v. Perez, 121 F.Supp.2d 317 (S.D.N.Y. 2000). Protective custody inmates at a state prison brought a [sections] 1983 action challenging their conditions of confinement. The district court dismissed the case, finding that the inmates failed to exhaust their administrative remedies prior to filing suit. The court also found that certain complained-of conditions of confinement were insufficiently serious to constitute Eighth Amendment violations as a matter of law.
