U.S. District Court: CONDITIONS ADA-Americans with Disabilities Act EXERCISE SANITATION MEDICAL CARE SEGREGATION.

Roop v. Squadrito, 70 F.Supp.2d 868 (N.D.Ind. 1999). An inmate who was HIV-positive and incarcerated in a county jail on an outstanding arrest warrant brought a [sections] 1983 claim and a claim under the Americans with Disabilities Act (ADA) against county officials. The district court denied summary summary judgment for the defendants. The court held that evidence raised an issue of material fact as whether the inmate's medical condition required that he be treated differently from other inmates in the jail, in violation of ADA. The inmate bad informed jailers that he was HIV-positive upon his arrival at the jail and he was given an initial medical assessment. According to the inmate, he was told that because of "your medical condition, and you having AIDS, you're going to be locked down." He was initially housed by himself in an old shower room, which had a working shower but no flushable toilet. After five days he was moved to a solitary cell located close to the jail's command module, where there was no toilet or shower in the cell.
