A. Trustee’s Deed

Once a sale has been completed, and if there has been no valid notice of redemption, discussed in Chapter 10 of this Guidebook, a trustee’s deed should be furnished to the high bidder. Of course, that person should be asked to provide the name(s) and address of the person(s) to be listed as grantee(s) in the trustee’s deed. Section 443.380, RSMo 2016, provides that recitals relating to “default, advertisement, sale or receipt of the purchase money, and all other facts pertinent thereto” are “prima facie evidence . . . of the truth thereof.” This provision is a powerful incentive to include many recitals in the trustee’s deed even though those recitals would not be among the minimum requirements for a...
