As some of our readers may have noticed, we at Constitutional Commentary are fond of legal fictions. This of course refers to more than just the articles and "But Cf." columns. As some of our more astute readers may have observed, our actual publication date of issues often bears only the most imaginative correlation to the date listed on the cover. Our authors have noticed this too. Every now and then, an author, publishing in one calendar year, has shown the amazing prescience of being able to identify not only the holding but even the precise citation of a Supreme Court case decided at some (stated) date in the future!

Our authors are, indeed, brilliant individuals. But not quite that brilliant. We are working to fix our publication dates, as best a bunch of muddling law professors can.

As part of the process, we have adopted the ultimate legal fiction: Constitutional Commentary publishes three stimulating, amusing, accessible issues of insightful constitutional, well, commentary in a (stated) calendar year. Accordingly, we have decided henceforth and ever after to call these issues "Spring," "Summer," and "Fall," corresponding precisely (more or less) to the three seasons we enjoy here in...
