Dear Ms. Klein:

I read with great interest the excellent article authored by Lindsay Miller, “‘Columbine’ and Colorado’s Records Acts.” Ms. Miller covers lots of territory in a short piece, and footnotes her sources well for practitioners.

The one thing I would add to her article, having been both a litigator and government counsel, is that a phone call to the government’s attorney in advance can save considerable time, money and effort. I have found that when counsel tells me what she’s seeking, I can help fashion the CORA or CC JRA request in a way that assures a prompt response and, if there’s a serious disagreement over disclosure, assures that we have the issue well-framed for future court resolution I also recommend that, even though the adversary system at times complicates the limits of cooperation, counsel in the civil matter should coordinate government records requests...
