Many family law attorneys would like to provide mediation services, or be the "separate attorney" for a client in mediation, but do not have adequate training or experience in non-adversarial dispute resolution or collaborative methods to truly support clients in their mediated cases, resulting in difficult and even unsuccessful negotiations. This article discusses the approaches best suited to non-adversarial settlement and what characteristics make certain attorneys better suited to this mode of practice than others.
