Excused Absences by a Commissioner from Board of Fire Commissioner Meetings

Policy Statement

Pursuant to Town Law 176-c, the board of fire commissioners has the authority to establish its own rules and regulations defining excessive unexcused absences by members of the board of fire commissioners. Pursuant to that authority, this policy defines excused and unexcused absences from the meetings of the board of fire commissioners. Moreover, under Town Law §176-c, any fire commissioner may be removed for dereliction of duty. Dereliction of duty shall include, but not be limited to, excessive unexcused absences from regularly scheduled meetings. Removal for excessive absences are in addition to the reasons for removal set out in Public Officers Law §36. Also, any removal must follow the procedure for removal in Public Officers Law §36.
