SPECIAL PROCEEDINGS

Definitions and Features: A special proceeding is an expedited procedure for obtaining a judgment, usually
for relief other than damages. Special proceedings must be specifically authorized by statute. Unless a statute
authorizes a special proceeding, a party seeking an order must proceed by commencing an action.
The procedure for a special proceeding is similar to that for a motion. The special proceeding is commenced by
filing a petition and notice of petition or order to show cause. The court must make a summary determination
on the “return date,” based on the pleadings, papers, and admissions presented, unless triable issues of fact are
raised.
