Section 91 Replevin

Under §§ 533.110–533.140, RSMo 2000, if a person brings an action for replevin and fails to prosecute the action, the defendant may recover damages for the taking and detention of the property plus costs of the suit. A successful plaintiff can force the defendant to return the property or pay the value of the property. The plaintiff is also entitled to recover damages for injury to the property, damages for the taking and detention of the property, and costs of the suit.
