Section 904. Contractors' Recovery Fund

(a) Residential Contractors' Recovery Fund

The Registrar administers a residential contractors recovery fund. Under A.R.S. § 32-1132(A), any person injured by an act, representation, transaction or conduct of a residential contractor that is in violation of statutes or rules may recover from the fund an amount not more than $30,000 for damages. The action is to be brought in the county where the violation occurred. The amount of damages cannot exceed the amount necessary to complete the repair of a structure. If the claimant has paid a deposit and no actual work is performed, the award of damages cannot exceed the amount of the deposit plus 10% interest. Attorneys' fees can only be recovered in contested cases appealed to the superior court.

Under section B, those applying for or renewing licenses must pay an assessment of $600 for deposit in the fund during the biennial license period.
