D. (§9.72) Agreement Between Principal and Attorney in Fact When Health Care Decisions Authorized

The sample agreement set out in this section is based on the provisions of the DPA Act that validate a separate agreement between the principal and the attorney in fact with respect to the manner in which the attorney in fact is to carry out the duties under the DPAHC. This sample agreement also takes into account the special provisions of the DPAHC Act with respect to the making of health care decisions by an attorney in fact.

This agreement is made and entered into this _____ day of ______________________, 20____, by and between ____________________ of the county of _____________________, state of Missouri, as the Principal, with respect to the Power of Attorney for Health Care Decisions (hereinafter referred to as “Principal”), and ______________________ of the county of __________________, state of ______________________, designated as the [initial] Attorney in Fact appointed in the aforementioned power of attorney (hereinafter the “Attorney in Fact”).
