A. (§9.40) Notice of Claim Statutes

There are four statutes pertaining to different classes of cities that require notice of an injury to be given to the mayor before suit can be brought. The statutes apply to any injury resulting from a defect in the condition of a bridge, boulevard, street, sidewalk, or thoroughfare. The notice must be given within 90 days of an occurrence for which damage is claimed. The notice must state where and when the injury occurred, describe the character and circumstances of the injury, and state that the injured person will claim damages from the city. The statutes are:

§ 77.600, RSMo 2016 (third class cities);

§ 79.480, RSMo 2016 (fourth class cities);
