4. (§9.22) Necessity of the Deponent’s Signature

Rule 57.03(f) requires the deponent to read and sign the deposition after it is transcribed unless the deponent and the parties waive that right. The deposition does not need to be signed if the witness is ill, cannot be found, is dead, or refuses to sign.

In addition, the requirement of reading can be waived by the witness and by the parties. Waiving reading and signature removes the right to read and correct any mistakes before it is considered finalized. If reading and signature are waived, this waiver should appear on the record.
