7. (§9.21) Protection to Health Care Providers
As indicated in §9.13 above, § 404.719, RSMo 2000, which exempts third persons from liability, is not incorporated by reference into the DPAHC Act. Additionally, the incorporation of § 404.707.1 and .2, RSMo 2000, into § 404.810, RSMo 2000, of the DPAHC Act does not include § 404.707.3 of the DPA Act, which, in effect, protects third persons in their dealings with a person named as attorney in fact who is not qualified to act as an attorney in fact. The last sentence of § 404.810 indicates that the failure to incorporate these provisions was intentional in that it expressly provides that no other provision of the DPA...
