A. (§9.2) General Observations

The law establishes the elements of a claim or cause of action. The plaintiff has the burden of proof and will need to present evidence at trial in order to prevail. A defendant may or may not present evidence at trial, but if the defendant has a lawful defense, the defense attorney will have the burden of proof on that issue and will need to present evidence to prove the elements of the defense.
