C. (§9.18) Amount of Damages

The amount of damages awarded as sanctions varies greatly depending on the individual circumstances of each case. In cases located by this author, individual amounts varied from $74.75 in Whitman v. Livingston, 541 S.W.2d 61, 64 (Mo. App. W.D. 1976), up to an award of $27,500 in Bowman v. Burlington Northern, Inc., 645 S.W.2d 9, 14 (Mo. App. E.D. 1982). Both cases involved assessments of ten percent of the underlying judgment, presumably as authorized by § 512.160, now RSMo 2000.
