The requirement that all warrants be based on probable cause “supported by oath or affirmation” derives directly from the Fourth Amendment. In Missouri, that requirement is implemented by statute as well. Section 542.276.2 and .3, RSMo Supp. 2004, requires that the application and any accompanying affidavit be in writing and verified by oath or affirmation.
