3. (§9.17) Conditions Precedent to Withdrawal or Withholding of Nutrition or Hydration
There is a clear statutory command set out in § 404.820.4, RSMo 2000, mandating steps the physician must take before the doctor or the attorney in fact may authorize the withdrawal of artificially supplied nutrition or hydration:
1. The physician must attempt to explain to the patient the intention to withdraw nutrition and hydration and allow an opportunity for the patient to refuse.
