I. (§9.12) Operation of Motor Vehicle Waiver

A number of cases have construed the express statutory waivers for operation of motor vehicles and dangerous condition of property. It has been established that statutes waiving sovereign immunity are strictly construed. Beiser v. Parkway Sch. Dist., 589 S.W.2d 277 (Mo. banc 1979); Hale ex rel. Hale v. City of Jefferson, 6 S.W.3d 187 (Mo. App. W.D. 1999). The statutory waiver of § 537.600, RSMo 2016, for operation of motor vehicles provides that immunity of a public entity from liability and suit for compensatory damages for negligent acts or omissions is expressly waived in the following instance: “Injuries directly resulting from the negligent acts or omissions by public employees arising out of the operation of motor...
