2. (§9.10) Interrogatories and Depositions of Nonretained Expert Witnesses
Rule 56.01(b)(5) provides for the discovery of nonretained expert witnesses by interrogatory. An expert must be disclosed in response to this interrogatory when a witness is expected to offer expert opinions at trial. This is true whether or not the expert was retained by a lawyer for purposes of litigation (as opposed to an expert who was consulted on the case before any lawsuit was filed, e.g., a second opinion contractor, doctor...
