In Department of Social Services, Division of Youth Services v. Oliver, 261 S.W.3d 719 (Mo. App. W.D. 2008), the court held that the employer deprives the employee of adequate notice by sending the notice too late to give the employee a reasonable opportunity to respond. The employer sent a certified letter on July 1 to the employee, notifying him that he had until July 8 to respond to the reasons for his proposed dismissal as set forth in the letter.
