The Occupational Safety and Health Act of 1970 (OSHA), 29 U.S.C. §§ 651 et seq., provides standards for safe operation in the workplace. 29 U.S.C. §§ 654 and 655. OSHA requires employers to retain records regarding:

• the employer’s activities subject to OSHA

• work-related deaths, injuries, and illnesses other than minor injuries that require first aid but no medical treatment, loss of consciousness, restriction of work or motion, or transfer to another job; and

• exposure to potentially toxic materials or harmful physical agents that are monitored or measured under OSHA
