N. (§8.30) Use of Photocopies
Counsel should include in the DPA a provision allowing for the use of photocopies. Generally, if such a provision is included, it should be easier to persuade a third party to rely on a copy. But there are instances, such as recording the instrument in the real property records, when a copy is not acceptable. In those instances, the original must be used.
