H. (§8.24) Third-Party Protections

The DPA Act contains extensive third-party protections. Any third party acting in good faith may rely and act on a power of attorney without liability to the principal or the principal’s successor in interest. Section 404.719.1, RSMo 2000. In addition, in the absence of actual knowledge, a third party can contract or deal with the attorney in fact or its successor and is not responsible for inquiring into the following:

“The authenticity of a certified true copy of a power of attorney,” § 404.719.1(1), RSMo 2000.

“The validity of the designation of the attorney in fact or successor,” § 404.719.1(2).
