L. (§8.23) “No Damages for Delay” Clauses—Public Works Contracts
Section 34.058, RSMo 2000, invalidates “no damages for delay” clauses in a public works contract that purports to bar a contractor’s right to obtain additional compensation for delays caused in whole or in part by the public entity. The statute excludes from its ban contracts with the Missouri Department of Transportation and also acknowledges that there are certain related contractual provisions that are still enforceable:
