J. (§8.21) Owner Liability to Contractor for Delay

Under both Missouri common law and the typical construction contract, the owner can be held liable for delaying or interfering with the contractor’s performance. AIA Document A201-1997, General Conditions of the Contract for Construction (15th ed.), contains a specific provision permitting the owner to suspend the progress of the work. Paragraph 14.3.1. It also provides for an adjustment in the contract price for costs incurred as a result of such a delay. Paragraph 14.3.2. Similarly, in the government contracts context, the government’s suspension of the work entitles the contractor to an equitable adjustment in the contract price if the work is delayed for “an unreasonable period of time.” 48 C.F.R. § 52.242-14(b).
