A. (§8.1) Background
A power of attorney is a written document whereby the principal appoints an agent and grants to the agent the authority to perform certain acts in the principal’s stead. At its core, the power of attorney creates an agency relationship between the principal and the agent. Under the common law in Missouri, a power of attorney is either suspended or terminated upon the incapacity of the principal. Evans v. York, 217 S.W.2d 749 (Mo. App. E.D. 1949).
