Bad economic times seem to expose frauds, excesses, and ethical lapses that may have gone undetected or been unintentionally overlooked when the economy performed at a high level, employment and corporate profits were on the rise, and defaults were few. The political and philosophical “sea change” reflected in the 2008 election will likely result in a swift return to a climate of more regulation and enhanced compliance obligations to address both real and perceived lapses by prior regulators.
