Upon receipt of an OSHA citation, an employer has 15 working days to notify the Secretary that the employer wishes to contest the citation or proposed assessment of penalty. 29 U.S.C. § 659(a). If the employer fails to contest within 15 working days (and no notice is filed by any employee or representative of employees within that time), the citation and the proposed assessment of penalty are deemed a final order of the Review Commission and not subject to review by any court or agency.
