Perhaps the largest change from prior law in the Missouri statutory scheme comes from the 1999 revisions to § 327.411, RSMo Supp. 2004. Section 327.411 now indicates that the design professional must maintain a personal seal that must be affixed to all “final” documents prepared by the professional, including plans, specifications, plats, reports, surveys, proposals, and other documents or instruments prepared by the licensee or under the licensee’s immediate personal supervision. The statute also sets the personal seal of the design professional as the equivalent of the licensee’s signature wherever used, and the owner of the seal must be responsible for the contents of whatever documents contain the seal. These same requirements apply to registered land surveyors in Missouri.
