The Employee Retirement Income Security Act of 1974 (ERISA),
29 U.S.C. §§ 1001 et seq., governs the provision and maintenance of all plans providing certain welfare and pension benefits to or on behalf of employees. ERISA requires employers to file certain reports, including:

• plan documents, such as

( a summary plan description;

( any merger agreements; and

( trust documents related to the plan;

• Form 5500 annual reports

• Form 5330 excise tax reports

• U.S. Department of Labor “top hat” letters; and

• various Pension Benefit Guaranty Corporation documents regarding

( the payment of premiums;

( funding status; and

( changes to or termination of the plan.

Employers that are required to file these reports must retain records regarding the disclosures, including information that would help verify, explain, or clarify the reports. 29 U.S.C. § 1027...
