Unless it is the state of Missouri or a county, “[t]he claimant shall file a sufficient bond, approved by the court, executed by the claimant as principal and one or more sufficient sureties to the effect that they are bound to the State of Missouri in an amount set by the court but not exceeding double the amount claimed.” Rule 85.08(a). Without the bond, the writ of attachment cannot issue. Rule 85.04. Even though § 521.050, RSMo 2000, says a bond is not necessary when the suit is against a nonresident defendant, Rule 85.08 supersedes the statute—see Rule 41.02—and a bond is always required...
