V. (§7.33) Conclusion

If discovery is to be effective, it must be aggressive. The procedures under Rule 25 are not the only methods of seeking discovery. Preliminary and bail reduction hearings often require the prosecution to disclose evidence and produce witnesses. Affidavits in support of search warrants and motions to suppress evidence also may provide discovery without the need to resort to depositions. Counsel should always be creative.
