2. (§7.31) By the State

Rule 25.14 provides a limited right of the state to take depositions. The Rule states that the state may file a motion to take a deposition to preserve a witness’s testimony subject to the defendant’s rights of personal confrontation and cross-examination. The state must serve the application to take the deposition on the defendant and the defendant’s attorney.
