B. (§7.3) Missouri Constitution

Article I, § 18(b), of the Missouri Constitution permits the state in felony cases to take the deposition of any witness within the state if the court finds that it is necessary to preserve the witness’s testimony, provided that the defendant’s right of confrontation (art. I, § 18(a)) is preserved. State v. Granberry, 491 S.W.2d 528, 531 (Mo. banc 1973).
