F. (§7.25) Rebuttal Witnesses
Generally, there is no requirement that the state endorse its rebuttal witnesses unless they are called to rebut the defense of alibi or mental illness. State v. Gillis, 812 S.W.2d 887, 891 (Mo. App. E.D. 1991). The defendant cannot expect the court to grant a continuance because of the state’s late endorsement of witnesses called to rebut the defendant’s alibi if the late disclosure was a result of the defendant’s untimely notice that the defendant would rely on the defense...
