B. (§7.2) Distinguishing Zoning Ordinances and Other Property Regulation Ordinances

It is important to distinguish zoning regulations from other property regulations because of the requirements that may accompany the different exercises of the government’s police power.

In City of Green Ridge v. Kreisel, 25 S.W.3d 559 (Mo. App. W.D. 2000), the municipality passed an ordinance regulating junkyards. A junkyard owner in the city was found in violation of the ordinance. On appeal, the owner alleged that the ordinance was a zoning ordinance, had not been properly enacted under the provisions of Chapter 89, RSMo, and, therefore, was invalid.
